Mayor Zohran Mamdani said Sunday that he and Police Commissioner Jessica Tisch will look at the entire 24-hour period that started with Thursday’s ICE shooting in Marble Hill. Their review will examine the conduct of federal agents as well as how NYPD officers handled the scene and the protests that followed.

The wounded man, a 28-year-old immigrant from the Dominican Republic, was shot during an ICE operation in Marble Hill while his 5-year-old son sat in the car. His neck injury was minor, and the boy came through unharmed. The case is now in the hands of Bronx District Attorney Darcel Clark, whose office has opened an investigation.

Mamdani compares the Marble Hill ICE agent to a mass shooter

Footage from Thursday shows the man wounded and handcuffed while an agent stands beside him with a long gun, a neon-yellow construction vest over his clothes. Speaking in a Sunday interview, the mayor said someone seeing the plainclothes agent could easily have mistaken him for a mass shooter. He faulted ICE for shooting at a moving car in broad daylight, repeated that the agency should be abolished and should stop operating in New York City, and said federal agents “view the law as a suggestion.”

According to the mayor, Trump and Mullin both wanted city police to take the man into custody, and he turned them down. “On what warrant?” he said he asked. Hours of negotiations Thursday evening failed to win the man’s release from ICE custody, Mamdani said, though he intends to keep talking with the administration.

Homeland Security says the shooting was justified

The Trump administration defends the shooting, alleging the man “weaponized his vehicle” against agents. Mullin said the man struck the car ahead of him before speeding toward officers. On Sunday, Mullin said footage from the agents’ body cameras will be made public. Authorities said the man was convicted of grand larceny in 2023. In a separate case still pending, which alleges he sold drugs, he has entered a not guilty plea. Mullin also read off a list of earlier charges and said the man is tied to a gang.

Police played no role in the shooting itself, but their conduct afterward drew criticism. At a protest at the scene, video shows officers shoving Darializa Avila Chevalier to the ground. She won the Democratic nomination for the House seat covering Marble Hill and has since demanded that Tisch resign or be fired. Mamdani called it unacceptable to throw any New Yorker to the ground and said he would not defend it. He has said before that he has no plans to replace Tisch.
